Pemerintah menerbitkan Peraturan Pemerintah Pengganti Undang-Undang (Perpu) Nomor 2 Tahun 2022 tentang Cipta Kerja pada 30 Desember 2022. CELIOS melakukan telaah dan analisis terhadap Perpu tersebut dari sisi ekonomi dan hukum.

CELIOS merekomendasikan agar DPR membuka ruang partisipasi publik dalam pembahasan Perpu Cipta Kerja sebelum disahkan menjadi undang-undang, serta mendorong masyarakat sipil untuk mengawal proses pembahasan ini.

Selain itu, CELIOS menekankan pentingnya pemerintah menjelaskan secara terbuka, objektif, dan rasional kriteria “Kegentingan yang Memaksa” dalam penerbitan Perpu, dan mendorong masyarakat sipil melakukan upaya hukum melalui Judicial Review ke Mahkamah Konstitusi.

CELIOS recommends that the House of Representatives (DPR) open public participation in the discussion of the Job Creation Perpu before it is enacted into law, and encourages civil society to actively monitor this legislative process.

Additionally, CELIOS emphasizes the importance of the government providing a transparent, objective, and rational explanation of the “Urgent Necessity” criteria used to issue the Perpu, and urges civil society to pursue legal action through a Judicial Review at the Constitutional Court.
